Fawehinmi Takes Bold Step: Sues Jonathan, SSS, Seeks IBB’s Arrest


Another bold step was taken on Monday by Mohammed Fawehinmi, son of the late human rights lawyer, Chief Gani Fawehinmi, when he sued President Goodluck Jonathan and heads of the national security agencies for the increasing wave of bombing and killing in the country.

Fawehinmi had also requested from Justice Binta Nyako of a Federal High Court, Lagos for a leave to apply for an order of mandamus, demanding for the arrest of former military President, Gen. Ibrahim Babangida.

Fawehinmi had also sued the heads of Economic and Financial Crimes Commission, the State Security Service and the Defense Intelligence Agency.

Others sued are the Inspector-General of Police; Head, Special Anti-bomb squad of the Nigerian Police, the Attorney-General of the Federation and the National Security Adviser.



At the hearing on Monday, the presiding judge had asked the plaintiff to present his written address in support of his application, while case resumes on Wednesday for further hearing.

In his suit, dated November 30, 2011, Fawehinmi has presented before the court 16 national issues to be decided.

One of the issues among many is whether Babangida can be vindicated of any “wrongdoing or involvement in the coordination of the recent bombing incidents that had occurred since October 1, 2010,” in spite of unresolved killing of the renowned journalist Mr. Dele Giwa, by a parcel bomb under his regime. He equally demanded for clarifications on whether Babangida actually carried out an investigation in relation to the death Dele Giwa.

The applicant also seeks the court interpretation on whether Nigeria can be described as safe, and if it can be said that Jonathan has performed his national duties in accordance with the provisions of the constitution, considering the continuous unrest and bombings in the country.

Demanding for the arrest of the former Minister of Defence, Adetokunbo Kayode, Fawehinmi wants the court to determine if Kayode and his predecessor, Bello Haliru, had knowledgeably carried out their duty as stipulated in the constitution of the Federal Republic of Nigeria.

The applicant also seeks the removal of the Minister of Defence, Mr. Bello Haliru to be replaced “a young vibrant military retired senior officer who can carry out his duty effectively”.

Fawehinmi, who was unsure whether the different heads of government agencies such as EFCC, the police and the SSS had performed their duties as laid down in the constitution and other law books, wants the court to order for their intelligence report before the October 1st bombing in 2010.
